Terms of Service

These Terms of Service ("Terms") govern your use of Beapnow Quizly ("Quizly", "the Service"), including:

• The website at quizly.beapnow.com and related web pages
• The iOS / iPad application distributed through the Apple App Store (where available)
• Related features that connect to the same Quizly accounts and backend

By accessing or using Quizly on any supported platform, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Quizly is a multi-platform product that lets instructors and organizations create quizzes, share them via links, access codes, or printable QR codes, collect submissions in real time, and grade responses. You may use Quizly through the web app, the iPad app, or both with the same account when you sign in with the same provider (Google, Apple, or email). Students and other participants can complete quizzes without creating an account. Optional paid plans unlock higher limits and AI-assisted quiz generation. Instructors may export and import quiz backups between workspaces where the product provides those tools.

2. Accounts and workspaces

• Personal workspaces are for individual creators.
• Business / team workspaces are for organizations; owners may invite members via invite codes.
• You may sign in with Google, Sign in with Apple, email and password, or continue as a guest (where offered).
• You must provide accurate registration information and keep your credentials and devices secure.
• You are responsible for all activity under your account and for how your workspace members use the Service.
• Guest sessions can be linked to a permanent Google, Apple, or email identity so that quizzes and credits remain on the same account; you should link or export before clearing browser or app data if you need to keep access.

3. Web and iOS clients

• Feature availability may differ slightly between web and iOS; we aim for a shared account and quiz experience across devices.
• You must use a supported browser or a genuine App Store copy of the iOS app. We may require minimum OS or browser versions for security.
• You must not reverse engineer, redistribute, or use the iOS app in violation of Apple’s App Store terms or applicable law.

4. Quiz participants

Participants access quizzes through links or codes provided by the quiz author. The level of participant information collected is determined by the instructor or organization running the quiz, not by Quizly alone.

• Participants may be asked only for a display name — which can be a pseudonym, nickname, or other identifier with no verified identity.
• Alternatively, instructors may design quizzes that encourage or require more identifiable responses (e.g. full name, student number in the name field, or detailed written answers), depending on their educational or business needs.
• By submitting a quiz, participants agree that their responses will be visible to the quiz author and authorized graders for that workspace.

Instructors and organizations are responsible for informing participants what data is collected, obtaining any required consent, and using submission data in compliance with applicable laws and institutional policies.

5. Sharing, QR codes, and exports

You control how quizzes are shared. Links and QR codes you distribute may allow anyone with the URL or code to access a quiz, depending on visibility settings. You are responsible for who receives share links, codes, and exported backup files. Quizly may log aggregate QR open events (quiz identifier only) to improve sharing features, as described in our Privacy Policy.

6. Acceptable use

You agree not to:

• Use Quizly for unlawful, harmful, harassing, or deceptive purposes
• Upload content that infringes intellectual property or privacy rights of others
• Attempt to bypass security, App Check, or access other users' data without authorization, or abuse invite codes
• Overload or disrupt the Service (including automated scraping or denial-of-service)
• Use AI generation features to produce harmful, misleading, or policy-violating content
• Misrepresent Quizly staff or use platform admin tools without authorization

We may suspend or terminate access for violations.

7. Your content

You retain ownership of quizzes, questions, images, and other content you upload. You grant Quizly a limited license to host, process, and display your content solely to operate the Service (including syncing to participants across web and mobile clients and storing submissions).

You represent that you have the rights to the content you publish and that participant data is collected and used in accordance with your obligations to participants.

8. Paid plans and billing

• Paid subscriptions and purchases on the website are typically processed through Stripe.
• Paid subscriptions or in-app purchases in the iOS app, when offered, are processed through the Apple App Store and are also subject to Apple’s terms and refund policies.
• Prices, limits, and features are described in the product and may change with notice.
• Subscriptions renew according to the billing period you select unless cancelled through the same channel you used to purchase (Stripe customer portal / product UI, or Apple ID subscription settings for App Store purchases).
• Refunds are handled according to the payment processor’s and our published practices at the time of purchase (Apple manages App Store refunds).

9. Free tier and service availability

We offer a free tier with usage limits. We strive for high availability but do not guarantee uninterrupted access on every platform. We may modify, limit, or discontinue features with reasonable notice where practicable.

10. Privacy

Our Privacy Policy explains how we handle personal information for web and iOS use, including Sign in with Apple, guest accounts, and the flexible approach to participant data described above.

11. Third-party services

Quizly integrates with Firebase (Google Cloud), Stripe, Google reCAPTCHA / App Check (web), Sign in with Apple, Google Sign-In, Apple App Store distribution, and AI providers when you use AI features. Your use of those services may be subject to their own terms and policies, including Apple’s Licensed Application End User License Agreement where applicable to App Store software.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. QUIZLY DOES NOT WARRANT THAT GRADING, AI-GENERATED CONTENT, OR SUBMISSION SYNC WILL BE ERROR-FREE ON EVERY DEVICE. INSTRUCTORS SHOULD REVIEW AI-GENERATED QUESTIONS AND AUTOMATED SCORES BEFORE RELYING ON THEM FOR HIGH-STAKES DECISIONS.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEAPNOW QUIZLY AND ITS OPERATORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify and hold harmless Quizly from claims arising out of your content, your use of the Service (web or iOS), your treatment of participant data, or your violation of these Terms.

15. Termination

You may stop using Quizly at any time, including by uninstalling the iOS app or closing your web account. We may suspend or terminate your access for breach of these Terms or to protect the Service. Upon termination, your right to use the Service ends; provisions that by nature should survive (liability limits, indemnity, governing law) will survive. Uninstalling the app does not automatically delete server-side data — contact us for account deletion.

16. Governing law

These Terms are governed by the laws of Australia, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of the jurisdiction where the Service operator is established, unless mandatory consumer protection laws in your country require otherwise. Nothing in these Terms limits rights you may have under the Australian Consumer Law or other non-waivable consumer protections.

17. Changes

We may update these Terms. Material changes will be reflected in the "Last updated" date. Continued use after changes constitutes acceptance.
